Terms of Service

Welcome to Madden Multimedia. These Terms of Service (“Terms”) govern your access to and use of our website and our video production services.

1. Agreement to Terms

By accessing our site or engaging our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.

2. Services and Deliverables

  • Production Scope: We will provide video production services as defined in a signed Statement of Work (SOW) or project quote.
  • Client Responsibilities: Clients must provide necessary materials (logos, branding, talent releases) on time to maintain the project schedule.
  • Revision Policy: Unless otherwise stated, each project includes Two (2) rounds of professional revisions. Additional revisions will be charged at our hourly rate.

3. Payments and Billing

  • Deposits: A non-refundable deposit of Fifty Percent (50%) is required to secure any filming or production dates.
  • Final Payment: Remaining balance is due upon final approval of the master video deliverable.
  • Late Fees: Projects exceeding payment deadlines by more than Fourteen (14) days may incur a 5% late fee.

4. Intellectual Property

  • Ownership: Upon final payment, the client is granted full ownership and usage rights of the final master video deliverables.
  • Raw Footage: Raw footage remains the property of Madden Multimedia unless explicitly purchased as an additional deliverable.
  • Portfolio Use: We reserve the right to include any finished projects in our portfolio and social media channels for self-promotion.

5. Cancellations and Rescheduling

  • Cancellations: Cancellations made within Forty-Eight (48) hours of a scheduled shoot may be subject to a cancellation fee of 25% of the shoot cost.
  • Rescheduling: We will make every effort to reschedule for legitimate reasons (e.g., weather for outdoor shoots, medical emergencies).

6. Limitation of Liability

Madden Multimedia is not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services. Our maximum liability is limited to the total amount paid by the client for the specific project.

7. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any disputes shall be settled in the courts of New Jersey.
